Conditions of Sale
Estimates
Estimates provided in our catalogues are intended solely as a guide. Actual sale prices may be higher or lower. For most regular items, estimates are based on current market values. However, for rare, unique, unusual items and bulk lots, estimates are only an informed opinion and may vary significantly at auction.
Pre-Auction Viewing
Please schedule an appointment to visit Roman Auction Pty Ltd and inspect any lots you are interested in prior to bidding.
Pre-Online Bidding
Pre-bidding will be available two weeks before the auction date. Please refer to details of our upcoming auction for specific opening times.
Collection and Payment
Lots must be collected on the day of the auction unless alternative arrangements have been made with Roman Auction Pty Ltd. No lots can be collected until full payment has been received.
Payment methods:
- Bank cheque: accepted.
- Personal cheques: accepted, but limits apply unless you are known to us. Cheques over a certain amount must clear before goods are released.
- Visa and Mastercard: accepted; a 1.5% surcharge will be added to your invoice.
- Debit cards: no surcharge.
- Overseas clients: payment must be made by bank transfer only.
Postal bidders will be invoiced after the auction, and payment is due immediately. Penalties and fees will apply for late payments.
Room bidders must pay for and collect their lots on the day of the auction. A late collection service fee of $50 applies to bidders who fail to collect on time.
Lots described as collections or containing undescribed items are sold with all faults and errors (if any). The purchaser of any such lot has no right of return or rejection. Any discrepancies must be reported immediately.
Ownership of Goods
Ownership of all lots remains with Roman Auction Pty Ltd until the purchase price is paid in full. If payment is by personal cheque, ownership does not transfer until the cheque has cleared.
The Purchaser
The highest bidder shall be the purchaser. The auctioneer has sole discretion to determine the highest bidder. All lots are offered subject to any reserve price set by the seller. The seller reserves the right to bid personally or via an agent (which may include the auctioneer) and to withdraw any lot before or during the sale.
It is the buyer’s responsibility to verify the accuracy of their purchase at the time of delivery. Roman Auction Pty Ltd accepts no liability for discrepancies discovered after removal of the lots from the premises.
In the event of any dispute between bidders, the auctioneer may, at their discretion, settle the dispute or re-offer the lot for sale either during the auction or as soon as practical afterward.
Lots that have been inspected in person are non-returnable. Postal bidders with concerns must contact Roman Auction Pty Ltd immediately upon receipt of their items to discuss any issue before attempting a return.
Absolutely no returns will be accepted more than 21 days after the auction date, as vendors will have been paid. No returns are accepted for any lot that has been tampered with.
Important: We do not accept responsibility for items not meeting buyer expectations of PCGS grading. No refunds will be issued for this reason.
Postal Bidding
Postal bids are recorded in the order received. If two bids are for the same amount, the bid received first takes precedence, subject to floor bidding. All bids are treated in strict confidence.
Please note:
- Roman Auction Pty Ltd accepts no responsibility for errors from telephone bids.
- We are not liable for mistakes arising from illegible handwriting—please write clearly in block letters.
- While every effort will be made, we accept no responsibility for late bids received by phone, fax, or email on auction day.
Auctioneer Bidding
The auctioneer may bid on behalf of the vendor or prospective purchasers, and such bids:
(i) Do not need to be expressly stated to be effective;
(ii) Will be considered valid if recorded in the sale book.
Buyers may be required to provide their name and address and/or pay part or all of the purchase price at the conclusion of the sale.
Failure to comply entitles the auctioneer to re-sell the lot.
Agents bidding on behalf of undisclosed clients accept personal responsibility for payment and safe delivery of the lots. Roman Auction Pty Ltd is not liable for any default by the purchaser or vendor.
Bids from minors will not be accepted unless accompanied by a cash deposit or suitable guarantees.
Each lot is sold as genuine unless otherwise described. Items described as having defects are not returnable due to condition. Grading descriptions are the opinion of the cataloguer and may differ from other opinions. Disputes are to be resolved at the auctioneer’s discretion.
Admission and Discretion
Roman Auction Pty Ltd reserves the right to control admission to the viewing and auction premises, and to refuse bids or entry without explanation.
Interpretation of Conditions
Any disputes regarding these Conditions of Sale shall be conclusively determined by the auctioneer.
Buyer’s Commission
Please note: A 22% buyer’s commission (inclusive of GST) will be added to your invoice.
Vendor T&Cs
Terms and Conditions for Items Received for Auction
All lots and individual items consigned for sale and/or auction are received by Roman Auction Pty Ltd (hereinafter referred to as the Auctioneer) and are placed for sale subject to the following terms and conditions.
The Auctioneer reserves the right to sell or offer for auction any lots or items in respect of which the Vendor has failed or refused to provide a duly signed copy of these terms and conditions prior to the sale or auction.
Note: Estimates are provided as a guide only. Items may sell above or below the estimate. A vendor’s commission fee will be determined based on the size, content, value, and type of consignment, and will be confirmed during the consignment process. Payment due to the Vendor will be made once the Trust Account has been balanced (normally within 30 days).
- Ownership Warranty
 The Vendor warrants and guarantees that they are the true and absolute owner of the lots or items or are properly authorised to sell them by the rightful owner. The Vendor agrees to provide any evidence of ownership or authorisation as may be required by the Auctioneer.
- Authenticity Warranty
 The Vendor warrants that all lots or items are genuine (unless otherwise noted) and are not counterfeit, forged, altered, or misrepresented. The Auctioneer reserves the right to seek expert opinion regarding authenticity, and any associated costs will be borne by the Vendor.
- Limitation of Liability
 While the Auctioneer will take all reasonable care in handling and storing consigned items, all items are accepted on the condition that the Auctioneer is not responsible for any loss or damage of any kind.
- Right of Refusal
 The Auctioneer reserves the absolute discretion to refuse or reject any lot or item without providing a reason.
- Manner of Sale
 The Auctioneer retains full discretion over how lots and items are offered for sale. The Vendor authorises the Auctioneer to list items in a manner consistent with the Auctioneer’s experience, market conditions, and estimated prices as presented in the Auction Catalogue. The Auctioneer also reserves the right to refuse any bid and to advance bidding at their discretion.
- Withdrawal of Lots
 If a lot is withdrawn from auction after a receipt has been issued, the Vendor is liable to pay a withdrawal fee equal to 10% of the Auctioneer’s estimate to cover work undertaken, including but not limited to advertising, valuation, insurance, and cataloguing.
- Lien on Withdrawn Lots
 The Auctioneer shall hold a lien over any withdrawn lots in the amount of the applicable withdrawal fee. This lien remains in force until the fee is paid in full.
- Estimates and Reserves
 All lots offered for auction at the Auctioneer’s estimates are unreserved and may sell above or below the estimated price. If the Vendor places a reserve not agreed to by the Auctioneer, and the item remains unsold, a fee will apply:- $50 per lot
- $200 per lot for items valued over $10,000
 
- Payment of Sale Proceeds
 Payment to the Vendor will generally be made within 30 days of the Auction Date (or within 45 days for higher-priced items where necessary to secure a sale). If a buyer has not paid in full within this period, the Auctioneer retains absolute discretion to withhold payment until the purchase price has been received in full.
- Minimum Administration Fee
 If no items are sold at auction, a minimum administration fee of $50 may apply at the Auctioneer’s discretion. This fee must be paid prior to the return of the items, plus applicable postage costs.
- Insurance
 The Auctioneer recommends that the Vendor insure all consigned items. Insurance is charged at 1% of the reserve value provided by the Vendor. Insurance can be arranged at the time of consignment by selecting the insurance option on the Auction Vendor Agreement.
- Unsold Lots
 Unless otherwise instructed, all unsold lots will automatically be carried forward to the next auction. In such cases, reserve amounts may be reviewed and adjusted by mutual agreement between the Vendor and the Auctioneer.
- Post-Auction Reserve Discount
 If a consigned item or lot does not meet its reserve, a pre-agreed Vendor Reserve Discount may be applied to facilitate a sale during the Post Auction Sale period. The Vendor Reserve Discount is agreed in advance on the Auction Vendor Agreement.
